It has been heard that on February 24, 2022, a three-member bench headed by Chief Justice of Pakistan Umar Atta Bandial will hear the case related to the free movement of our national hero Dr. Abdul Qadeer Khan in the Supreme Court of the Islamic Republic of Pakistan.Is it ironic that Dr. Abdul Qadeer Khan has left the world on October 10, 2021, half a year before this hearing and is now waiting for the Supreme Court to decide on his movement and he can visit the heavenly palaces where Blessings are waiting for them. Maybe someone from above has made a recommendation and the case has been fixed for hearing, otherwise, in our country, decisions are made even after two or three years of people’s death. Dr. Sahib is fortunate that his case was scheduled for hearing only six months after his departure.
It should be noted that this usually happens to helpless and helpless Pakistanis. Because even if the people with authority and status are alive, not only their cases come and are heard on a daily basis, but sometimes the respected judges even on their vacation days would hold court and deal with the case. arePerhaps this is the reason why the judiciary of Pakistan, which came into existence in the name of Islam, is ranked 124/117 in the world judiciary ranking, and it is the same judiciary whose judges earn millions per month from the blood and sweat of the nation. Receive salary with benefits. But the state of justice is that generations pass away while waiting for justice. People come from the throne to the floor, children grow old, but our justice system does not miss the mark.
There is a need for the Supreme Judiciary to deal with more than 21 lakh pending cases on priority basis while thinking of setting its house in order so that justice can be provided to the dead as well as the living. In this regard, some reports are presented with great literature:Judicial reforms should be implemented for speedy justice.More than 1000 vacant posts of judges should be filled on priority basis.By changing the method of recruitment of judges, they should also be recruited through competitive examinations so that only competent and honest people can become a part of the justice system instead of incompetent, useless and recommended people.
The law regarding the judges who do not decide the cases as soon as possible should be implemented 100%. The corrupt judges should be made a lesson. The black sheep in the lawyers should be brought to justice.
Those who perjury, false cases should be ensured not only recovery of damages but they should also be arrested.
A few years ago, in a TV program in India, a Muslim member of the assembly was asked whether the law of the Quran is good or the law of India. He replied that there are more than three crore cases pending in the courts of India, which require many years to be disposed of. Just implement Quran system for one year and then see how these cases are resolved and you will know whether Indian law is good or Quran law.In India, it is not possible to implement the law of the Quran, but in the country created in the name of Islam, i.e. Pakistan, we can implement the law of the Quran. Surely this is possible, then why the delay? Just implement Quranic law for one year to dispose of pending cases and see the result.
Once, a woman named Fatima from Bani Makhzoom family was arrested for theft. His tribe wanted him not to be punished for cutting off his hands. He sent Hazrat Osama bin Zaid as an intercessor in the service of the Holy Prophet to request some leniency in the punishment. The Holy Prophet’s face turned red and he said: “The first nations were destroyed because when an influential man committed a crime, he was saved by interpreting the law for his sake.” He said, “By Allah, if my daughter Fatima had stolen in her place, I would have cut off her hands too.”
We should learn from this incident. Legal equality should be established among all members of the society and rule of law should prevail. The saying is true that “in a state that shows mercy to criminals, innocent people die with great cruelty.”In today’s era, millions of innocent and innocent people lose their lives mercilessly in mosques, imambargahs, bazaars, vegetable markets, dargahs, schools and universities in suicide attacks and bomb blasts. Therefore, without justice and fairness, an ideal and peaceful society cannot be imagined. No nation in the world can deny its necessity and importance.
Only through justice and fairness can a person see a glimpse of heaven in this life and the society can become a cradle of peace and tranquility. It should also be kept in mind that unnecessary delay in the judgment of the court is tantamount to not giving justice and it also encourages the criminals. If institutions and government fail to establish justice in a society and injustice starts everywhere, then Allah Almighty has the power to change that nation and replace it with another nation.Hazrat Ali said that “Government cannot be established on the basis of oppression, but it can be based on disbelief.”The main reason for the increasing street crimes, kidnapping for ransom, street prostitution, child labor and their cruel treatment is that the criminals are not caught. Influential people try to use all their influence but the Supreme Court should have supremacy. As a Muslim, we have a dual responsibility to establish justice. May Allah grant us all success. (Amen)
